Terms of Service

Note: This English version is provided for convenience only. In the event of discrepancies between the German and English versions, the German version shall prevail to the extent permitted by applicable law.

1. Scope

These Terms of Service ("Terms") govern the use of the services provided by baitme, including its website, web application, and desktop application.

By using baitme, users agree to be bound by these Terms.

2. Definitions baitme

baitme is the platform provided by the operator for the creation, management, and automated evaluation of Baits.

Streamer

A Streamer is a natural person who creates a baitme account and uses the baitme services.

Viewer

A Viewer is a natural person who creates a Bait and commits to a performance-based payment.

Bait

A Bait is a challenge provided by baitme that can be evaluated automatically.

A Viewer may configure parameters such as target values, time limits, or payment amounts within the limits defined by baitme.

Evaluation rules, success criteria, and permitted parameters are defined by baitme.

Successful Bait

A Bait is considered successful when the success criteria defined by baitme have been determined as fulfilled through the automated evaluation process.

3. Description of Services

baitme provides a technical platform through which:

Viewers can create Baits, Streamers can receive and complete Baits, game events can be evaluated automatically, payments can be processed via Stripe Connect.

baitme is neither a party to any agreement between Viewers and Streamers nor a holder of user funds.

4. User Accounts

A user account is required to use baitme as a Streamer.

Authentication is available exclusively through supported OAuth providers.

Users are responsible for protecting their connected accounts against unauthorized access.

5. Age Requirements

Users must be legally permitted under applicable law to perform the actions associated with using baitme.

Users under the age of 18 may only use baitme with any legally required consent from their parent or legal guardian.

By using baitme, users confirm that they satisfy these requirements.

6. Creation of Baits

When creating a Bait, the Viewer:

selects a Bait type provided by baitme, configures available parameters within the limits defined by baitme, authorizes the payment associated with the Bait, agrees to the conditions associated with the selected Bait.

Creating a Bait constitutes a binding commitment to make the specified payment if the Bait is successfully completed.

Payment Limits

baitme may establish minimum and maximum payment amounts for Baits.

Applicable limits will be displayed within the services.

baitme may modify such limits at any time.

Activation of Baits

Depending on the design of the service, a Bait may:

become active immediately, or require acceptance by the Streamer.

If acceptance by the Streamer is required and the Bait is not accepted, the Bait will be terminated and the payment authorization will be released or otherwise not used.

baitme is not obligated to accept or evaluate every Bait.

7. Viewer Agreement

Viewers who do not maintain a user account agree to these Terms and the Privacy Policy by creating a Bait or authorizing a payment.

baitme may implement technical measures requiring explicit acceptance before a Bait is submitted.

8. Automated Evaluation

The determination of whether a Bait has been successfully completed is made exclusively through automated evaluation of game events collected by the baitme desktop application.

The automated evaluation result is binding on both Viewers and Streamers.

Users have no right to:

manual review, re-evaluation, correction of an automated decision.

baitme strives to provide reliable and accurate evaluations but cannot guarantee that technical errors will never occur.

9. Desktop Application and Game Integrations

To evaluate Baits, the desktop application may access official interfaces of supported games.

The application may modify local game settings where necessary to enable such official interfaces.

Users agree to these modifications when using the service.

10. Payment Processing

Payments are processed through Stripe and Stripe Connect.

Payment authorization may be obtained before a Bait becomes active.

If a Bait is successful, the authorized payment may be captured.

If a Bait is unsuccessful, the payment will not be captured and the authorization may expire or be released.

baitme does not store credit card information or banking details.

Authorization, collection, and payout processes are handled by the respective payment service providers.

11. Platform Fees

baitme may retain a platform fee from successful Baits.

Applicable fees will be disclosed to users in an appropriate manner.

12. Beta Status

Some or all baitme services may be provided as beta software.

Beta services may contain bugs, be incomplete, or become temporarily unavailable.

Users acknowledge that technical issues may occur, particularly during beta periods.

13. Prohibited Use

The following activities are prohibited:

manipulation of game events, circumvention of technical safeguards, automated attacks against the platform, abuse of payment functionality, unlawful use of the services, technical interference intended to influence automated evaluations. 14. Prohibited Baits

Baits must not:

violate applicable laws, infringe the rights of third parties, promote hatred, discrimination, or harassment, encourage fraud or deceptive conduct, encourage violence, self-harm, or dangerous activities, contain sexual or pornographic content, promote gambling or comparable prohibited activities, violate the terms of supported games or platforms.

baitme reserves the right to remove, reject, disable, or otherwise restrict such Baits at any time.

15. Suspension of Users and Removal of Content

baitme may temporarily or permanently suspend user accounts and may remove, reject, or disable Baits if:

these Terms are violated, a violation of applicable law is suspected, abuse or manipulation is suspected, technical or security reasons require such action, the legitimate interests of baitme or other users are affected.

Users have no right to restoration of removed Baits or suspended accounts.

16. Availability

baitme does not guarantee uninterrupted availability of its services.

Service interruptions or limitations may occur due to:

maintenance, game updates, changes to game APIs, outages of Stripe, outages of Twitch, outages of Discord, outages of Steam, other technical disruptions. 17. Limitation of Liability

baitme shall be liable without limitation in cases of willful misconduct and gross negligence.

In cases of ordinary negligence, baitme shall only be liable for breaches of essential contractual obligations and only for foreseeable and typical damages.

These limitations do not apply to:

injury to life, body, or health, liability that cannot be excluded under applicable law.

To the extent permitted by law, baitme shall not be liable for:

malfunctions of supported games, changes to game interfaces, decisions made by third-party platforms, failures of third-party services, incomplete or inaccurate game events, financial losses arising from unsuccessful, failed, or incorrectly evaluated Baits. 18. Supported Games and Integrations

baitme supports selected games, platforms, and technical integrations.

Availability of individual integrations may change at any time due to actions taken by game developers, platform operators, or other third parties.

baitme does not guarantee the continued availability of any specific game or integration.

Supported integrations may be expanded, restricted, modified, or discontinued at any time.

baitme may modify, expand, restrict, or discontinue Bait types, parameter limits, evaluation rules, and success criteria at any time.

19. Account Termination and Deletion

Streamers may request deletion of their account at any time.

Account deletion requires that:

no outstanding payouts remain, no pending payment authorizations or payment processes remain, no active Baits remain.

Before account deletion, any active Baits will be terminated and cancelled.

Upon successful account deletion, the connection between the baitme account and the associated Stripe Connect account will be removed.

Personal data stored by baitme will then be deleted unless retention is required by applicable law.

Deleting a baitme account does not delete the associated Stripe account.

20. Changes to Services

baitme may modify, expand, restrict, or discontinue features, supported games, integrations, and other aspects of the services at any time.

21. Changes to These Terms

baitme may amend these Terms with future effect.

Registered users will be informed of material changes in an appropriate manner.

22. Governing Law

These Terms shall be governed by the laws of the Federal Republic of Germany, excluding the United Nations Convention on Contracts for the International Sale of Goods (CISG).

If the user is a consumer, mandatory consumer protection provisions of the country of the user's habitual residence remain unaffected.

23. Severability

Should any provision of these Terms be held invalid or unenforceable, the remaining provisions shall remain in full force and effect.
